The Nevada Department of Agriculture (NDA) Division of Measurement Standards is proposing changes to Nevada Administrative Code (NAC) Chapter 581. The proposed changes include the following:

  • Adopts by reference the National Conference on Weights and Measures (NCWM) Publication 14, which pertains to the NCWM’s National Type Evaluation Program (NTEP).
  • Updates the requirements related to traceability of certain weighing and measuring devices to an active certificate of conformance, expanding the authority of the State Sealer of Measurement Standards to authorize the use of types of weighing and measuring device that are not traceable to an active certificate of conformance to include those device or system types which do not have evaluation procedures published in the National Conference on Weights and Measures Publication 14. Further, a definition is established for one-of-a-kind devices and authority is granted to State Sealer of Measurement standards to authorize the use of one-of-a-kind devices which have not been issued an NTEP certificate of conformance if such device(s) comply with the requirements of National Institute of Standards and Technology Handbook 44.
  • Elimination of the adoption by reference of the Uniform Open Dating Regulation.
  • Updates to the fees charged for the calibration services provided by the Nevada Metrology Laboratory
  • Updates to the schedule for certification of standards used by a service agency or serviceperson to repair or adjust a weighing or measuring device
  • Elimination of the requirement that a person who installs or makes a repair or adjustment to a weighing or measuring device used as commercial weighing or measuring equipment must provide oral notice of such action to the State Sealer of Measurement Standards

Updates to where certain standards adopted by reference can be obtained and how they may be purchased
This survey is part of NDA's initial steps in assessing the impact of these proposed changes in accordance with Nevada Revised Statute (NRS) 233B.0608. Participation in this survey is voluntary and data that you provide will be used to help the NDA draft a business impact statement. This statement, created from the results of this survey, will be available as part of a future public workshop announcement. In addition to completing this survey, you may also provide public comment on these proposed changes at a future workshop, which will be announced after the survey closes.
