Business Impact Surveys: Proposed changes to NAC 557

The Nevada Department of Agriculture (NDA) is conducting a survey to assess the potential impacts of proposed changes to Chapter 557 of the Nevada Administrative Code(NAC) on businesses. The changes proposed to NAC pertains to the regulation of hemp. Please follow the survey link below to access the survey. This survey should take 5-10 minutes to complete. Please review the proposed changes to NAC 557 prior to taking a survey. The deadline to complete the surveys is Monday, Jan. 19, 2026.

The purpose of this proposed regulation is to align state and federal definitions and regulations to maintain a federally compliant hemp program in Nevada. Compliance with federal law is required for Nevada hemp to enter the national marketplace. The proposed regulation change only impacts hemp production and preharvest testing, as it pertains to the acceptable level of THC in a hemp crop. These changes will not change or impact regulations pertaining to hemp products or postharvest uses of hemp. Additionally, this regulation does not change the current acceptable THC level of not more than 0.3 percent on a dry weight basis.

This proposed regulation updates the definition of “Total THC” and “post- decarboxylation” in NAC 557 to align with existing federal regulations (7 C.F.R. § 990.1). This change also replaces references in existing state regulations regarding the amount of THC contained in hemp to “Total THC”.

Please note, this survey is the first step in assessing the impact of these proposed changes in accordance with Nevada Revised Statute (NRS) 233B.0608. Participation in this survey is voluntary, and data that you provide will be used to help the NDA draft a business impact statement. This statement, created from the results of this survey, will be available as part of a future public workshop announcement. In addition to completing this survey, you may also provide public comment on these proposed changes at a future workshop, which will be announced after the survey closes.
