NDA Administrative Rulemaking Process

The Nevada Department of Agriculture (NDA) invites all interested parties to provide input on proposed regulation changes.

What is Nevada Administrative Code (NAC)?

NAC is the codified administrative regulations that govern certain activities of the NDA and its divisions and interprets law or policy.

    Why is NAC being changed?

    Proposed regulation changes can result from a variety of factors including changes to Nevada Revised Statutes (NRS), which are the current codified laws of the State of Nevada, changes to federal laws, or the need to clarify NRS.

      How can I provide input on proposed NAC changes?

      Public comment is a mechanism built into the State rule-making process and is your opportunity to influence the rule or regulation, help identify solutions and propose alternatives, and make your voice and experience heard. A comment can be as brief as a sentence, address specific aspects, or respond to all aspects of a proposed regulation.       Opportunities for input from the public are announced in the following order:
       
      1. Determining if the proposed regulation will have a small business impact in accordance with NRS 233B.0608. The NDA posts electronic surveys to collect input from small businesses. Surveys regarding proposed regulation changes are posted to the NDA website and sent out via email to the NDA’s customer list.

      2. A public workshop is scheduled and noticed on the NDA meetings and events website, notice.nv.gov and leg.state.nv.us, and emailed to the NDA’s customer list to solicit comments from the public. Comments may be made verbally during the workshop, or in writing before, during or after a workshop as indicated on the meeting notice.

      3. The Legislative Counsel Bureau (LCB) will review proposed regulations and may adjust to conform with regulatory formatting and authority, after which, a Hearing and Intent to Adopt Proposed Regulations will be scheduled and noticed on the NDA meetings and events website, notice.nv.gov and leg.state.nv.us. and emailed to the NDA’s customer list to solicit comments from the public. Comments may be made verbally during the hearing, or in writing before, during or after a hearing as indicated on the meeting notice.
